iPad“商標(biāo)侵權(quán)”案

Trademark infringement就是指“商標(biāo)侵權(quán)”，是指行為人未經(jīng)商標(biāo)權(quán)人許可，在相同或類似商品上使用與其 trademark registration(注冊(cè)商標(biāo))相同或近似的商標(biāo)，或者干涉、妨礙商標(biāo)權(quán)人使用其注冊(cè)商標(biāo)，損害商標(biāo)權(quán)人legitimate interest(合法權(quán)益)的其他行為。行為人銷(xiāo)售明知或應(yīng)知是counterfeit registered trademark(假冒注冊(cè)商標(biāo))的商品, right to exclusive use of trademark(商標(biāo)專用權(quán))被侵權(quán)的natural person(自然人)或者legal entity(法人)在civil affairs(民事)上有權(quán)要求侵權(quán)人cessation of infringement(停止侵害)、eliminate ill effects(消除影響)、redress damage(賠償損失)。
