電信詐騙受害人被凍結(jié)資金三日內(nèi)返還

銀監(jiān)會(huì)、公安部20日發(fā)布《電信網(wǎng)絡(luò)新型違法犯罪案件凍結(jié)資金返還若干規(guī)定》。《規(guī)定》要求，對(duì)已查明的凍結(jié)資金，要按照依法溯源的原則，及時(shí)返還人民群眾，減少損失。公安機(jī)關(guān)不得以權(quán)謀私，收取任何費(fèi)用。

銀監(jiān)會(huì)和公安部聯(lián)合發(fā)布規(guī)定，幫助電信詐騙受害者盡快追回受騙資金。

電信詐騙（telecom fraud/scam）犯罪近些年愈演愈烈，造成人民群眾巨大的財(cái)產(chǎn)損失（property loss）。在查處電信詐騙犯罪分子的過程中，銀行可以協(xié)助公安機(jī)關(guān)對(duì)特定賬戶進(jìn)行凍結(jié)（freeze accounts involved in the scam）。

The regulation requires the banks to assign case-specific personnel in charge of returning the telecom fraud money.
規(guī)定要求銀行指定專人負(fù)責(zé)電信詐騙資金返還工作。

According to the regulation, after the victim's application to the police has been approved, the banks should return the money within three days.
根據(jù)規(guī)定，電信詐騙受害者的資金返還申請(qǐng)獲警方批準(zhǔn)后，銀行應(yīng)該在三天之內(nèi)返還資金。

If the bank fails to assist the police, the bank can face penalties from the CBRC.
若銀行不協(xié)助警方相關(guān)工作，將面臨銀監(jiān)會(huì)的處罰。

《規(guī)定》要求的返還程序如下：

1. 萬一被騙，第一時(shí)間要報(bào)警，記住轉(zhuǎn)款的賬戶而且提供匯款的憑證（call the police and present evidence）。

2. 警方通過“涉案資金緊急止付系統(tǒng)”（the emergency suspension of payments invloved in the scam），直接將涉案賬戶“秒鎖”并緊急止付。即使贓款到了犯罪分子的賬戶，他也無法操作。

3. 警方主動(dòng)與被害人聯(lián)系，依法辦理資金返還工作（禁止收取任何費(fèi)用）（the police contact the victim and deal with returning of fraud money）。

4. 被害人向凍結(jié)公安機(jī)關(guān)或者受理案件地公安機(jī)關(guān)，填寫《電信網(wǎng)絡(luò)新型違法犯罪涉案資金返還申請(qǐng)表》（the victim applies for returning of the fraud money at public security organs）。

凍結(jié)賬戶內(nèi)僅有單筆匯(存)款記錄，可直接溯源被害人的，直接返還被害人（if there is single record of money transfer in the account that can be traced back to the victim, the money will be returned to the victim）。

情況2

凍結(jié)賬戶內(nèi)有多筆匯(存)款記錄，按照時(shí)間戳記載可以直接溯源被害人的，直接返還被害人（if there are multiple records of money transfer in the account that can be traced back to the victim, the money will be returned to the victim）。

情況3

凍結(jié)賬戶內(nèi)有多筆匯(存)款記錄，按照時(shí)間戳記載無法直接溯源被害人（if there are multiple records of money transfer in the account that cannot be traced back to any victim）。

公安機(jī)關(guān)應(yīng)當(dāng)發(fā)出公告，公告期為30日，公告期內(nèi)被害人、其他利害關(guān)系人可就返還凍結(jié)資金提出異議，公安機(jī)關(guān)依法進(jìn)行審核（potential victims report to the police）。

按照被害人被騙（盜）金額占凍結(jié)在案資金總額的比例返還（the money will be returned to the victims based on the amount of money involved in the fraud）。

如查清新的被害人，公安機(jī)關(guān)可以按照本規(guī)定啟動(dòng)新的返還程序（if new victims appear, the police will go through the same procedure again）。
